The Information Blocking Rule is a regulation set under the 21st Century Cures Act and became effective on April 5, 2021 (Huang et al., 2023). This rule prevents healthcare providers, health IT developers, and health information networks from withholding EHI from patients unless a permitted exception exists. It is to make the process more open and engage patients in decision-making processes. By doing so, patients can view their records such as progress notes, laboratory results, and imaging reports in real time. For the nurses, this means that documentation must be done efficiently, effectively, and on time. Because patients can view their records shortly after they have been created, any ambiguous, partial, or overly complicated notes could potentially confuse, upset, or potentially a complaint.
Impact on Clinical Workflow
The Information Blocking Rule has led to fundamental changes in clinical processes, including documentation of the patient’s details. From this, nurses and other healthcare providers need to rethink the time, what they document, and how detailed they are when documenting (Demsash et al., 2023). This is especially so since patients get full access to their health records, clinical notes, tests, and imaging reports in real time. Therefore, nurses might be required to write in simple language, with the understanding that any data they enter may be readily seen and understood by the patient. This means that there is a need to change the way documents are produced and/or presented, to be more precise, clear, and professional. In addition, it has been pointed out that healthcare organizations have also realized the need to improve the training offered to the students to meet the changes. Some have brought in training sessions with the aim of making the staff understand the need to be very careful when preparing the documents as well as the ramifications of releasing information that may be misinterpreted. This training is aimed at strengthening the communication aspect and at the same time ensuring that all articles written are easily understood by the patients while at the same time being medically accurate. Furthermore, interprofessional communication has become even more important.
Our Organization Is Responding
As a result of this federal requirement, our organization has put in place a new documentation policy that meets the requirements of the Cures Act. This means that nurses should avoid using medical terms when documenting and writing notes and should explain their decision-making where necessary. We have changed the default for our electronic health record (EHR) system to allow patient access in real-time unless there is a specific reason not to (Ali et al., 2023). Seminars and workshops are conducted periodically to ensure that all the stakeholders are conversant with the policy and to create a platform where the challenges emerging from the implementation of the policy are discussed.
